Terms of service.

Acceptance

By using this site and/or engaging our services, you agree to these terms. If you do not agree, please refrain from using the site or subscribing to our services.

Services provided

Our monthly retainers and fixed-fee projects are described on /services and /pricing. Engagement-specific terms are detailed in your signed service agreement, which prevails over public pages in case of conflict.

Payment

Monthly retainers: billed in advance, per 30-day cycle. 3-month initial term, then monthly rolling. 3-month notice to cancel after month 3. No cancellation fees.

Fixed-fee projects: 50% at signing, 50% at delivery, unless otherwise stated in the agreement. Late payments may result in deliverables being withheld.

Prices are in CAD, excluding GST/QST.

Intellectual property

The client owns final deliverables upon full payment. 26 Branding Agency retains the right to use the work in its portfolio and marketing communications, unless otherwise agreed in writing.

Working sources (raw files, unfinalized projects, intermediate assets) remain the property of 26 Branding Agency unless otherwise agreed in writing.

Limitation of liability

Our total liability to the client, for any cause whatsoever, is limited to the amount paid in the most recent 3 months of service. We are not liable for indirect, consequential, or lost-profit, lost-clientele, or lost-data damages.

Mutual confidentiality

Both parties agree to treat as confidential all non-public information exchanged during the engagement (strategy, data, clients, pricing). A formal NDA can be signed on request.

Jurisdiction

These terms are governed by the laws of Quebec, Canada. Any disputes will be resolved in Montreal courts. The French and English versions have equal force, per the Charter of the French Language (Bill 96).
